If a U.S. seller misses a revised shipping date you already accepted for an unshipped e-bike preorder, explicitly choose whether to wait again or cancel. A renewed delay notice cannot simply count your silence as agreement. If you previously agreed to wait indefinitely, the notice rules differ, but that does not remove your continuing cancellation right once the applicable date has passed and before shipment.
Find the Last Agreed Shipping Date

Put the original promise and the revision you accepted side by side. You need the shipping commitment, not a hopeful arrival estimate or a tracking label's creation date. Under the applicable federal order rule, shipment means the merchandise has physically entered the carrier's possession.
Identify the exact preordered item from your confirmation. Other electric bikes showing as available do not establish that your order is ready or that you agreed to a substitute. Keep the original purchase and any replacement offer separate when replying.
Identify Which Delay Notice This Is
The distinction between an initial delay and a further delay matters. Limited circumstances allow a first delay notice to treat silence as consent. That should not be carried forward as a blanket rule for repeated missed dates.
For a renewed delay after an agreed definite date, the seller must seek your express consent to keep waiting or cancel and provide the required refund. A prior, express agreement to an indefinite delay follows a different notice path. Do not assume every later update starts an identical deadline or automatically cancels that arrangement.

Make a Clear Choice About Waiting Again
Ask whether the seller can provide a new shipping date or whether the estimate is genuinely indefinite. Then decide whether waiting still works for you. A bike intended for a specific trip may no longer serve that purpose even if you still like it.
You can make the decision plain: "I agree to wait until the revised shipping date stated in your message," or "I do not agree to another delay. Please cancel my unshipped order and arrange the refund." Keep the response and the notice it answers together.

Confirm Cancellation and the Refund
